These Terms and Conditions (“Terms”) govern your use of Praepara Home (the “App”), a Windows desktop application owned and operated by Modus Creatio L.L.C. and distributed through the Microsoft Store. By accessing or using the App, you agree to be bound by these Terms in their entirety. If you do not agree, you must not use the App.
Section 1 — Informational Purpose & Limitation of Liability
1.1 Educational and General Guidance Purpose
The Praepara Home application and all content, tools, calculators, letter and document templates, reference data, and materials contained herein are provided strictly for informational, educational, and general organizational purposes to assist users in documenting home inventory, tracking home insurance claims, tracking new-construction builder and third-party structural warranties, and organizing related correspondence and legal matters.
1.2 No Substitution for Official Policy, Warranty Terms, or Legal Advice
This App does not constitute, provide, or replace: official insurance policy terms, a builder’s or third party’s actual written warranty contract, legal advice, financial advice, or formal claims-processing or litigation procedures. Users are solely responsible for verifying any information derived from the App — including deadlines, coverage assumptions, and reference figures — against their actual policy documents, warranty contracts, and current, jurisdiction-specific law before taking action.
1.3 Use At Your Own Risk
1.4 No Security Guarantee
- No digital system can guarantee absolute security
- Modus Creatio L.L.C. does not guarantee that the App or any data stored within it will be free from unauthorized access, data breaches, or security vulnerabilities
- Modus Creatio L.L.C. shall not be liable for any unauthorized access to, or disclosure of, your data
- You assume full responsibility for securing your Windows user account, your device, and any backups of your data — see Section 8 for how the App’s encryption is tied to your Windows account specifically
1.5 Limitation of Liability
Some states and jurisdictions do not allow the exclusion or limitation of implied warranties or certain damages. In such jurisdictions, the exclusions and limitations in this Section 1.5 apply only to the maximum extent permitted by law, and the remaining limitations set out in this Section 1.5 continue to apply in full.
If, notwithstanding the foregoing, Modus Creatio L.L.C. is found liable to you for any claim arising out of or relating to these Terms or your use of the App, Modus Creatio L.L.C.’s total aggregate liability to you for all claims, in the aggregate, shall not exceed the greater of (a) the total amount you paid to Modus Creatio L.L.C. for the App in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty U.S. dollars ($50). This cap applies regardless of the legal theory on which liability is based (contract, tort, statute, or otherwise) and even if Modus Creatio L.L.C. has been advised of the possibility of such damages.
1.6 Legal Reference Content Is Not Legal Advice — No Attorney-Client Relationship
The App includes a “Legal” section and related warranty-tracking features that surface general reference information, including approximate statute of limitations and statute of repose ranges, approximate right-to-cure/right-to-repair notice periods, approximate small claims court dollar caps, and a self-assessment questionnaire relating to arbitration clauses (“Reference Content”). Regarding the Reference Content, you specifically acknowledge and agree that:
- The Reference Content covers only a limited subset of U.S. states and is not comprehensive
- All figures are approximate, may be out of date, and are periodically changed or amended by state legislatures and courts without notice to you or to Modus Creatio L.L.C.
- The Reference Content, and any “verdict,” flag, or summary the App generates from your answers (including the arbitration clause questionnaire), is not a legal opinion, legal advice, or a determination of your legal rights
- Using the App, including its letter-drafting and Reference Content features, does not create an attorney-client relationship between you and Modus Creatio L.L.C., and Modus Creatio L.L.C. is not a law firm and does not employ or supply attorneys through the App
- You are solely responsible for confirming current, applicable law in your jurisdiction with a licensed attorney before relying on any deadline, cap, notice period, or clause analysis surfaced by the App, and before sending any letter or notice the App helps you draft
Section 2 — Eligibility & Acceptable Use
2.1 Age Requirement
You must be at least 18 years of age to use this App. By using the App, you represent and warrant that you meet this requirement.
2.2 Prohibited Conduct
You agree not to: use the App for any fraudulent or illegal purpose; attempt to reverse engineer, decompile, or extract source code from the App; use the App to store or transmit any unlawful, harmful, or defamatory content; or interfere with or disrupt the integrity or performance of the App.
Section 3 — Subscription & Payment Terms
3.1 Free Trial
Praepara Home offers a 7-day free trial for new users on the Single Property tier. You will not be charged during the trial period. If you do not subscribe to a paid tier before the trial ends, the App locks and prompts you to choose a subscription tier to continue.
3.2 Subscription Tiers
After the trial, continued use requires an annual subscription to one of the following tiers, purchased and billed through your Microsoft account via the Microsoft Store:
| Tier | Price | Properties Covered |
|---|---|---|
| Single Property | $9.99/year | 1 property |
| Growing Portfolio | $29.99/year | Up to 3 properties |
| Small Portfolio | $77.99/year | Up to 10 properties |
| Unlimited | $155.99/year | Unlimited properties |
Pricing is subject to change as described in Section 3.7. Prices shown are in U.S. Dollars and may be adjusted by the Microsoft Store for your local currency and applicable taxes.
3.3 Auto-Renewal
3.4 Payment Failure & Grace Period
If a renewal payment fails, your subscription enters a 3-day grace period during which you retain full access while you resolve the payment issue (for example, by updating your payment method through your Microsoft account). If the issue is not resolved within the grace period, the App locks until a valid subscription is restored. No data is deleted during a grace period or lock — see Section 3.6.
3.5 Downgrades and Property Limits
Each tier limits how many properties you may actively manage at once, as shown in the table in Section 3.2. If you elect to downgrade to a lower-priced tier, the downgrade does not take effect immediately — you will retain your current tier, its property limit, and its price for the remainder of your current paid subscription period, and the downgrade (including the new, lower price) takes effect only at your next renewal date. Downgrading does not entitle you to a refund or credit, prorated or otherwise, for any unused portion of your current subscription period at the higher tier; your sole entitlement is to pay the lower tier’s price starting at the next renewal. Once the downgrade takes effect, if your new tier’s property limit is lower than the number of properties you currently manage, the App will prompt you to choose which properties remain active. Properties beyond your new tier’s limit become locked — their name and address remain visible so you can identify and, if you choose, delete them to free a slot, but their inventory, claims, warranty, and legal data are not accessible until you either upgrade to a tier that covers them or free up a slot. Locked property data is not deleted and is not transmitted anywhere; it remains encrypted on your device.
3.6 Cancellation
You may cancel your subscription at any time through your Microsoft account’s subscription settings. Cancellation takes effect at the end of the current billing period — you retain access to the App until that date. No partial refunds are provided for unused time within a billing period. Your locally stored data is never deleted by Modus Creatio L.L.C. as a result of cancellation, lock, or non-renewal.
3.7 Refunds
All refund requests are handled by Microsoft in accordance with the Microsoft Store’s refund policy, which may vary by region and is outside Modus Creatio L.L.C.’s control.
3.8 Price Changes
Modus Creatio L.L.C. reserves the right to change subscription pricing for any tier. You will be given advance notice of any price increase affecting your active subscription and the opportunity to cancel before the new price takes effect on your next renewal.
3.9 Subscription Value & Discontinuation
Modus Creatio L.L.C. may add features or value to a subscription tier at any time. We will not remove features or value from a subscription tier for customers who purchased that tier before the change, for as long as they remain subscribed to it. If Modus Creatio L.L.C. discontinues a subscription tier, we will continue to provide the digital goods and services you purchased under that tier until your current subscription period expires.
3.10 Renewal Reminder Notices
Where required by applicable state law (for example, for free trials or promotional periods lasting longer than 31 days), Modus Creatio L.L.C. will provide notice before your trial converts to a paid subscription or before an annual subscription renews, including a clear statement of the renewal price, the length of the renewal term, and instructions on how to cancel. Because subscriptions are billed and managed through the Microsoft Store, cancellation instructions will direct you to your Microsoft account’s subscription settings as described in Section 3.6. This notice is provided in addition to, and does not replace, any renewal reminder Microsoft itself may send in connection with Microsoft Store billing.
3.11 Store Delisting; No Independent Refund Obligation
All purchases and subscription payments for the App are processed exclusively by Microsoft through the Microsoft Store, and Section 3.7 governs how refund requests are handled. If Modus Creatio L.L.C. removes the App from the Microsoft Store, stops offering it for new download or purchase, or the App is removed or delisted by Microsoft for any reason (a “Delisting”):
- A Delisting affects only the App’s future availability for new download or purchase, and does not, by itself, terminate, suspend, or impair your existing installation, license, or active subscription — you may continue using any copy of the App you have already installed, and any active subscription will continue to be honored under Section 3.9 through the end of its then-current paid term, subject to the App’s ordinary operation
- A Delisting does not, by itself, entitle you to a refund, whether full or partial, of any amount previously paid for the App or any subscription tier, unless a refund is separately required under the Microsoft Store’s refund policy (Section 3.7) or applicable law
- Because Modus Creatio L.L.C. does not process, hold, or have access to your payment information or transaction history — all of which is held exclusively by Microsoft as the processor of the transaction — Modus Creatio L.L.C. has no independent mechanism to issue monetary refunds outside of Microsoft’s own refund process, and you agree to direct any refund request to Microsoft in accordance with Section 3.7
- Modus Creatio L.L.C. shall not be liable to you for any damages, losses, or costs arising from a Delisting, except to the extent a remedy is expressly required by applicable law
If Modus Creatio L.L.C. permanently discontinues the App (sunsetting) such that no further updates or support will be provided, we will provide reasonable advance notice as described in Section 10, consistent with applicable law.
Section 4 — Data Privacy & Local Storage
Praepara Home is designed with a privacy-first, local-only architecture. All data you enter — including property, room, and inventory records, photos, Vault documents, insurance policy and claim information, builder and third-party warranty records and claims, legal case tracking, and generated letters — is stored exclusively on your device in an AES-256 encrypted local database (via SQLCipher). Modus Creatio L.L.C. does not operate servers that receive, process, or store this data, and does not transmit, sell, or share it. Any cloud backup you choose to enable uses your own cloud storage account and is controlled entirely by you, as described in the Privacy Policy.
Section 5 — Third-Party Data & Open-Source Components
Certain features use publicly available third-party data sources, including: the National Weather Service (NWS), Open-Meteo, RainViewer, and OpenStreetMap/CARTO. Weather features are based on a location you manually enter (such as a property address or ZIP code) — the App does not use your device’s GPS or continuous location tracking. Modus Creatio L.L.C. does not own, endorse, or guarantee the accuracy of any third-party data. Weather alerts are informational only — always follow official emergency guidance from local authorities. All third-party services operate under their respective public APIs and terms of service.
Document and spreadsheet generation (PDF, Word, and Excel exports and letter drafts) is performed entirely on your device using open-source libraries, including PdfSharp, the Open XML SDK (DocumentFormat.OpenXml), and ClosedXML. Local encrypted storage is powered by sqlite-net-pcl and SQLitePCLRaw (SQLCipher edition). No data is transmitted to any external server during document generation, export, or database operations. See the Open Source Notices at the end of the Privacy Policy tab for license details.
Section 6 — Intellectual Property
All original content, design, logos, branding, and software code in the App are the intellectual property of Modus Creatio L.L.C. and protected by applicable copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works without prior written consent from Modus Creatio L.L.C.
Section 7 — Termination
Modus Creatio L.L.C. reserves the right to terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. All data stored locally on your device remains on your device and is not deleted by Modus Creatio L.L.C.
Section 8 — Vault Security, Encryption Key, & Data Loss
Praepara Home does not use fingerprint, face, or any other biometric authentication. Access to your locally stored data is controlled by your signed-in Windows user account: the App trusts an active, authenticated Windows session as its unlock boundary, and your database encryption key is protected using the Windows Data Protection API (DPAPI), scoped to your specific Windows user account on your specific device.
- Because your encryption key is scoped to your Windows user account via DPAPI, your locally stored data is generally only decryptable from that same Windows user account on that same device
- If your Windows user profile is deleted, corrupted, or becomes inaccessible, or if you reinstall Windows without preserving your user profile, your locally stored data may become permanently unreadable, and Modus Creatio L.L.C. cannot recover it
- If you use the App’s optional “Full App Backup” export feature, that backup file is protected by a separate passphrase that you choose. If you lose that passphrase, that specific backup file cannot be decrypted by anyone, including Modus Creatio L.L.C. You are solely responsible for storing this passphrase securely
- Modus Creatio L.L.C. shall not be liable for any data loss resulting from loss of Windows account access, device failure, or loss of a Full App Backup passphrase
Section 9 — Dispute Resolution
9.1 Binding Arbitration
9.2 Class Action Waiver
9.3 Right to Opt Out of Arbitration
You may opt out of the binding arbitration and class action waiver provisions in Sections 9.1 and 9.2. To opt out, you must send written notice to modus_creatiollc@pm.me within 30 days of the date you first accept these Terms, stating your name and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, neither you nor Modus Creatio L.L.C. will be required to arbitrate, and Section 11’s Governing Law provision will govern any dispute, which may be brought in the appropriate courts consistent with that provision. Opting out of arbitration does not affect any other provision of these Terms, including your continued right to use the App.
9.4 Small Claims Court Exception
Either party may bring an individual action in small claims court for disputes or claims within that court’s jurisdiction, in lieu of arbitration, whether or not you have opted out under Section 9.3.
Section 10 — Modifications to These Terms
Modus Creatio L.L.C. reserves the right to modify these Terms at any time. When material changes are made, the effective date will be updated and notice will be provided within the App where required by law. Continued use of the App after any changes constitutes your acceptance of the new Terms.
Section 11 — General Provisions
Geographic Scope: The App is offered and intended for distribution solely within the United States. Modus Creatio L.L.C. makes no representation that the App is appropriate, legal, or available for use outside the United States. If you access the App from outside the United States, you do so on your own initiative and are solely responsible for compliance with local laws.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Modus Creatio L.L.C. is incorporated, without regard to conflict of law principles.
Force Majeure: Modus Creatio L.L.C. shall not be liable for any failure or delay in performance due to causes beyond its reasonable control.
Assignment: You may not assign your rights under these Terms. Modus Creatio L.L.C. may assign its rights without restriction.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Entire Agreement: These Terms constitute the entire agreement between you and Modus Creatio L.L.C. regarding the App and supersede all prior agreements.
No Professional Advice: Nothing in the App constitutes legal, financial, insurance, or professional advice of any kind.
Relationship to Microsoft Store Terms: These Terms govern your relationship with Modus Creatio L.L.C. and your use of the App. Your acquisition of the App and any subscription, and the processing of the associated payment, are separately governed by Microsoft’s own Microsoft Store Terms of Sale and Microsoft Services Agreement, over which Modus Creatio L.L.C. has no control. If there is a conflict between these Terms and Microsoft’s own terms regarding the operation of the Microsoft Store or the processing of a transaction, Microsoft’s terms govern that transaction; these Terms otherwise continue to govern your use of the App itself.
Section 12 — Electronic Consent
By installing, launching, or otherwise using the App, you consent to enter into these Terms electronically. This electronic agreement is valid and enforceable under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001) and constitutes a binding electronic signature.
Section 13 — Contact
If you have questions about these Terms, please contact Modus Creatio L.L.C. at modus_creatiollc@pm.me.
By using the App, you confirm that you have read, understood, and agreed to these Terms, including the binding arbitration and class action waiver in Section 9, and consent to electronic contracting under the E-SIGN Act as described in Section 12.
Guidance only — not an official insurance policy tool, warranty administrator, or law firm. All information is provided for educational and general informational purposes only. Verify all data against your official policy documents, warranty contract, and current law. Modus Creatio L.L.C. is not liable for claim, warranty, or legal outcomes.

This Privacy Policy explains how Praepara Home (“App”), a Windows desktop application owned and operated by Modus Creatio L.L.C., handles your information. We built Praepara Home on a simple principle: your personal data belongs to you, and only you. Modus Creatio L.L.C. is the data controller for purposes of this Policy.
1. Information We Collect
Praepara Home does not collect, transmit, or store any personal data on external servers. The following data is created and stored exclusively on your device:
- Property, room, and home inventory records (photos, descriptions, serial numbers, estimated values)
- Personal and financial documents stored in the Vault
- Insurance policy and claim information, including generated letters and communication logs
- Builder and third-party home warranty records, claims, communication logs, and generated letters
- Legal case tracking (attorney contact info, case/docket numbers, court dates, notes) and arbitration-clause self-assessment answers, if you choose to use those features
- A weather location you manually enter (e.g. a property address or ZIP code), and cached weather/alert data for that location
- App preferences and settings
We do not use analytics SDKs, advertising SDKs, or any third-party data collection tools.
2. Sensitive Financial, Insurance, Warranty, and Legal Data
Praepara Home is designed to store sensitive information, including insurance policy and claim numbers, home warranty and third-party warranty details, contractor and builder contact information, payment and cost records, attorney and case information, and related documents. This information is directly related to the App’s core functionality of managing your home insurance claims and warranty records, and is only created in your local database when you choose to enter it into the relevant feature — no sensitive data is collected before or independent of your affirmative use of that feature. All such data is encrypted using AES-256 and stored exclusively on your device. This data is never transmitted to Modus Creatio L.L.C. or any third party. You are solely responsible for the accuracy and completeness of the information you enter.
3. How Data Is Stored and Secured
All data is encrypted at rest using AES-256 encryption via SQLCipher. The database encryption key is protected using the Windows Data Protection API (DPAPI) and is scoped to your specific Windows user account on your specific device — it cannot be used to decrypt your data from a different Windows account or a different device. Vault files (documents, photos, receipts) are separately encrypted with AES-256-GCM and stored in your device’s private application data folder. Modus Creatio L.L.C. operates with zero backend infrastructure. There are no Praepara servers that receive, process, or store your data.
4. Vault Access — No Biometric Data Collected
Praepara Home does not use fingerprint, face, or any other biometric authentication, and does not collect, store, or process biometric data of any kind. Access to your Vault and other locally stored data relies on your signed-in Windows user session — the App treats an authenticated Windows account as its unlock boundary. We recommend securing your Windows account itself with a strong password, PIN, or Windows Hello (a Windows operating-system feature, not something Praepara implements, controls, or has access to).
5. Full App Backup Passphrase
If you use the optional “Full App Backup” export feature, you choose your own passphrase to encrypt that backup file. This passphrase is never transmitted to or stored by Modus Creatio L.L.C. — it exists only in your memory or wherever you choose to record it. If you lose this passphrase, that specific backup file cannot be decrypted by anyone, including Modus Creatio L.L.C. This is separate from your Windows account access described in Sections 3–4 above, which is not passphrase-based.
6. Cloud Backup (Optional)
Praepara Home does not use any cloud provider’s API or OAuth sign-in. Instead, if you enable cloud backup, the App reads from and writes to a local folder on your device that your own cloud provider’s desktop application already keeps synced to your account — supported providers include OneDrive, Google Drive, Proton Drive, Dropbox, and iCloud. Before any file is placed in that folder, it is encrypted (AES-256-GCM for photo sync, or passphrase-based encryption for a Full App Backup export). Modus Creatio L.L.C.:
- Has no account access, API access, or server-side visibility into your cloud provider account
- Never receives a copy of your backup — it goes directly from your device into your own cloud-synced folder
- Cannot see, list, or restore your backups on your behalf
You can disable cloud backup at any time in the App’s settings, and you control retention and deletion of synced backup files entirely through your own cloud provider’s account and app.
7. Location Data
Praepara Home does not access your device’s GPS or any continuous/background location service. Weather features (forecasts, radar, and National Weather Service alerts) are based solely on a property address or location you manually type into the App. If you import photos that already contain embedded GPS coordinates from the device or camera that originally captured them, that existing metadata is preserved as part of the encrypted photo file on your device — Praepara Home does not read, extract, or transmit this metadata anywhere.
8. Third-Party Services
Praepara Home integrates with the following public APIs to deliver weather features, based on a manually entered location:
- National Weather Service (NWS) — weather alerts
- Open-Meteo — weather forecasts
- RainViewer — radar imagery
- OpenStreetMap / CARTO — map tiles
These services receive only the minimum data required (an approximate location) and operate under their own privacy policies. Praepara Home does not share your personal inventory, Vault, claims, warranty, or legal data with any third party.
Praepara Home also uses the following open-source software components on-device, entirely locally, to generate documents and manage encrypted storage — none of them transmit data anywhere:
- PdfSharp — generates PDF exports and letter drafts
- DocumentFormat.OpenXml (Open XML SDK) — generates Word (.docx) letter drafts and reports
- ClosedXML — generates Excel (.xlsx) exports
- sqlite-net-pcl and SQLitePCLRaw (SQLCipher edition) — encrypted local database storage
9. Data Sharing
Modus Creatio L.L.C. does not sell, rent, trade, or share your personal information with any third parties. The only data that ever leaves your device is: (a) an approximate, manually entered location sent to public weather APIs; (b) what you explicitly choose to export or share (such as emailing a generated PDF or Word letter to an insurer, builder, or attorney); or (c) encrypted backups written to your own chosen cloud-synced folder, as described in Section 6.
10. No Tracking or Advertising
Praepara Home contains no advertising of any kind. We do not use any device or advertising identifier for advertising purposes. We do not build behavioral profiles. We do not integrate with any ad networks, marketing platforms, or third-party analytics services.
11. Data Retention
All data retention is controlled entirely by you. Data remains on your device until you delete it within the App or uninstall the App. Uninstalling the App removes its locally stored application data from your device. Cloud-synced backup data can be removed at any time through your respective cloud provider’s own app or account settings.
12. Children’s Privacy
Praepara Home is intended for users 18 years of age and older. We do not knowingly collect personal information from children under 18. If you believe a child has used the App, please contact us and we will address it promptly.
13. Your Rights & Data Deletion
Because all data is stored locally on your device, you are always in full control. You may delete individual items within the App at any time, clear all App data through the App’s own “Clear All App Data” setting, or uninstall the App to remove all locally stored data.
California Residents (CCPA): You have the right to know what personal information we collect, the right to delete personal information, the right to opt out of the sale of personal information (we do not sell data), and the right to non-discrimination for exercising your privacy rights.
Virginia, Colorado, and Connecticut Residents: You have the right to access, correct, delete, and obtain a copy of your personal data, and to opt out of its sale (we do not sell data).
To exercise any of these rights, contact us at modus_creatiollc@pm.me. Because we have no server-side copy of your data, most of these rights are already exercisable directly within the App or through your device’s file system.
Geographic Scope: The App is offered and intended for distribution solely within the United States, and this Privacy Policy is written to address U.S. federal and state law. Modus Creatio L.L.C. does not knowingly market the App to, or target the App at, residents of the European Economic Area, the United Kingdom, or other jurisdictions outside the United States, and this Policy does not address rights arising under non-U.S. law (such as the GDPR or UK GDPR).
14. Changes to This Policy
Modus Creatio L.L.C. may update this Privacy Policy from time to time. Material changes will be communicated within the App and reflected in the updated effective date above. Continued use of the App after any changes constitutes your acceptance of the updated Policy.
